Terms of Service

1. Introduction

Welcome to Career Agent, a platform proudly operated by Career Agent (Pty) Ltd (“the Company”, “we”, “our”, or “us”), a private company registered in the Republic of South Africa. These Terms and Conditions (“Terms”) govern your use of the Career Agent mobile application and website (“the App”). By accessing or using the App, you agree to be bound by these Terms, which are designed to protect both your rights and ours, while ensuring full compliance with the laws of South Africa, including the Protection of Personal Information Act, 2013 (POPIA).

We value transparency, fairness, and your trust. Please read these Terms carefully before using our services.

2. Description of the Service

Career Agent provides technology-driven tools to assist job seekers, professionals, and employers in achieving their employment and recruitment goals. Our services include, but are not limited to:

• AI-powered job search and auto-application: Automatically finding and applying to suitable positions based on your profile and career interests.
• Automatic CV revamp and optimization using artificial intelligence (AI): Our system enhances layout, grammar, and formatting for better visibility in recruitment systems.
• ATS (Applicant Tracking System) scoring and feedback: The app checks the CV ATS score, revealing how it performs against modern applicant tracking systems and offering recommendations for improvements.
• Skill-level analysis and improvement suggestions: Assess how your current skills and experience match a target career path, and receive improvement recommendations and online course suggestions.
• Future career trends prediction: We provide insight-driven forecasts to help you plan your career trajectory.
• Access to professional CV consultants: for personalized editing and revamp services handled by verified human experts.
• Recruiter and employer services: enabling vetted employers to post jobs and use AI-assisted matching to discover suitable candidates. While we strive to improve your employability, we do not guarantee interviews, job offers, or employment outcomes.

3. Your Responsibilities

As a user of the App you agree that you will:

• Provide accurate, up-to-date, complete information when creating your profile, uploading your CV or using the service.
• Review and ensure the information in your CV and applications is true and reflects your genuine skills, experience, eligibility and interest before granting us permission to apply on your behalf.
• Use the App in a lawful manner, in compliance with all applicable laws including South African labour and data-protection laws.
• Keep your login credentials secure, and notify us immediately of any unauthorised access to your account.

4. Access to Your CV and Data Processing

By using the App you consent to the following:

• We may send your CV (and relevant profile information) to recruiters, employers, or job-platforms whose public contact details we identify.
• We may make your CV available (securely) to CV consultants who provide professional enhancement or review services.
• We process your data for providing the services described, including automatic application submission, skills analysis, trend forecasting, and CV transformation.

5. Data Ownership and Licence

You retain full ownership of any content you upload (such as your CV, profile information, documents). By uploading such material you grant us a licence to process, store, transmit and apply that content for the purpose of delivering the App’s services. This licence is non-exclusive, worldwide and royalty-free for the term necessary to provide the services.

6. Service Availability

We make reasonable efforts to provide uninterrupted service. However, we do not guarantee continuous, error-free access. We may suspend, restrict, or terminate service (temporarily or permanently) for maintenance, upgrades, or other business reasons.

7. Fees, Payments, and Refund Policy

Service fees are displayed within the App prior to payment and must be settled via approved third-party payment processors. All transactions are processed securely. We do not store or have access to your payment card details. Once automated job searches, AI revamps, or CV consultant services have commenced, no refunds will be issued.Refunds are only considered in exceptional cases where a service was not initiated due to a system failure attributable to us.

8. Changes to the Terms or Service

We reserve the right to modify these Terms at any time. We will publish changes via the App or by notifying you via email. Your continued use of the App after changes indicates your acceptance of the updated Terms.

9. Termination

We may suspend or terminate your access if you violate these Terms, or if you engage in conduct we reasonably believe to be inappropriate, illegal, or harmful. You may terminate your account at any time by following the in-App deletion process or contacting us. On termination, certain data may remain in our archives for legal, business continuity or regulatory reasons.

10. Disclaimers & Limitation of Liability

While we aim to deliver accurate and beneficial career tools and job-matching services, we cannot guarantee job offers, interviews or outcomes. We are not liable for the decisions made by recruiters or employers, your eligibility, or the final outcome of any job application.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa, including POPIA and the Electronic Communications and Transactions Act 25 of 2002, and any disputes will be subject to the exclusive jurisdiction of the courts of South Africa.
